Agreement to Terms
These Terms govern the use of Foundrhood services, operated by Foundrhood Ventures ("we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "User", "You") and Foundrhood Ventures, governing your access to and use of our website (foundrhood.com), bespoke web development services, digital marketing solutions, consulting, and associated software-as-a-service (SaaS) products (collectively, the "Services").
By accessing our website, submitting a project request, or utilizing any of our Services, you confirm that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these terms, you are expressly prohibited from using the Services.
Scope of Services
Foundrhood delivers digital transformation solutions including, but not limited to:
- Complimentary Starter Pages: Free one-page baseline website development as per promotional criteria.
- Custom Web Architecture & Engineering: Full-stack applications, WebGL visual systems, interactive web apps, and CMS integrations.
- Digital Growth Engines: SEO architecture, conversion rate optimization, automation pipelines, and digital marketing systems.
- SaaS Platforms & Developer Tools: Proprietary software tools, client portals, and hosting management frameworks.
Detailed deliverables, milestones, and project timelines for custom engagements will be stipulated in individual Statements of Work (SOW) or project proposals agreed upon prior to project commencement.
User Accounts & Obligations
When creating an account or providing project assets, you agree to:
Provide accurate, current, and complete business details, contact emails, and project requirements.
Ensure you hold all necessary rights, licenses, and permissions for any media, logos, or copy provided to us.
Maintain the confidentiality of any credentials or private repositories provided for project handover.
Refrain from using our services or hosted infrastructure for fraudulent, defamatory, or unlawful activities.
Intellectual Property Rights
Client Deliverables: Upon receipt of full payment for bespoke custom projects, all custom code, graphic design deliverables, and specific digital assets created exclusively for the client shall transfer to the client, subject to any open-source or third-party component licenses.
Foundrhood Proprietary Systems: Foundrhood retains all intellectual property rights in its pre-existing frameworks, internal development templates, SaaS infrastructure, reusable code modules, and proprietary algorithms.
Portfolio Display: Unless expressly agreed otherwise in writing via a Non-Disclosure Agreement (NDA), Foundrhood reserves the right to showcase completed client work and website links within our public portfolio and promotional case studies.
Billing, Subscriptions & Invoicing
- Agency Project Billing: Custom engagements are billed based on fixed milestones or retainer agreements as defined in your invoice or SOW.
- SaaS & Tool Subscriptions: Recurring software fees are billed in advance on a monthly or annual cycle and renew automatically unless cancelled before the renewal date.
- Taxes & Invoicing: All applicable taxes (including GST where applicable) are clearly itemized on tax invoices issued to you.

Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Foundrhood, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, or business interruption arising out of or related to your use of our Services. Our total aggregate liability for any claims under these Terms shall not exceed the amount paid by you to Foundrhood in the twelve (12) months preceding the claim.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any legal action, suit, or proceeding arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of India.
Modifications & Contact
We reserve the right to update or modify these Terms of Service at any time. Changes become effective immediately upon posting to this page. Your continued use of the Services following modifications signifies your acceptance.
